These SMS Messaging Terms & Conditions govern text message communications with Aqua Design Systems, Inc. ("Aqua Design Systems," "ADS," "we," "us," or "our").

1. Purpose of SMS Messaging

Aqua Design Systems provides text messaging capability primarily to facilitate ordinary business communications with customers, prospective customers, vendors, contractors, consultants, project participants, and other individuals who communicate with our company.
 

Our SMS messaging is intended primarily for conversational and informational business purposes. Messages may relate to inquiries, active or prospective projects, scheduling, coordination, service matters, requests for information, or other business communications.
 

Aqua Design Systems does not operate its SMS messaging service as a mass-market text-message advertising or promotional program.

2. How SMS Communications Are Initiated

Individuals may initiate communication with Aqua Design Systems by sending a text message to an SMS-enabled Aqua Design Systems telephone number, including our main office number at 770-716-5592.

Aqua Design Systems personnel may respond to such messages as reasonably necessary to address the inquiry or continue the applicable business communication.

Where Aqua Design Systems initiates an SMS conversation, the communication will generally relate to an existing inquiry, business relationship, project, service, scheduling matter, or other legitimate business purpose for which the recipient has provided his or her telephone number or otherwise consented to communication.

Consent to receive text messages is not a condition of purchasing goods or services from Aqua Design Systems.

3. Message Frequency

Message frequency varies based on the nature of the communication and the recipient's interaction with Aqua Design Systems. Because our SMS service is primarily conversational, there is no predetermined number of messages that a recipient will receive.

 

4. Message and Data Rates

Message and data rates may apply. Charges are determined by the recipient's wireless carrier and service plan. Aqua Design Systems is not responsible for charges imposed by a wireless carrier.

 

5. Opting Out

 

Recipients may opt out of SMS communications at any time by replying STOP to a text message from Aqua Design Systems.

 

After an opt-out request is received and processed, the recipient will no longer receive SMS messages through the applicable messaging program except as may be necessary to confirm the opt-out or as otherwise permitted by applicable law.

Opting out of SMS communications does not prevent a recipient from communicating with Aqua Design Systems by telephone, email, or other available means.

7. Supported Carriers and Delivery

SMS availability and delivery depend upon the recipient's wireless carrier and service. Wireless carriers are not liable for delayed or undelivered messages.

Aqua Design Systems does not guarantee that every text message will be received or delivered.

8. Privacy 

Information obtained through SMS communications is handled in accordance with the Aqua Design Systems, Inc. Privacy Policy.

Mobile telephone numbers and SMS opt-in or consent information will not be sold or shared with third parties for their marketing or promotional purposes.

Information may be provided to service providers that assist Aqua Design Systems in providing communications or business services, but only as reasonably necessary to provide those services and subject to appropriate confidentiality and data-use limitations.


9. Changes to These Terms

Aqua Design Systems may update these SMS Messaging Terms & Conditions from time to time. The current version will be made available on the Aqua Design Systems website.
